The Pay Per Rent Service is a web-based service available to qualifying residents of the United Kingdom, the Isle of Man and the Channel Islands (the "Territory") which entitles such residents to rent from Us one or more DVDs, Blu-ray Discs and/or games ("Rental Discs") provided that they pay to Us the rental charge (the "Rental Charge"). In order to use Our Pay Per Rent Service you must register your details with Us including your name, your postal address in the Territory, and e-mail address. By doing so you agree to be bound by these Terms and to Us processing your personal details in accordance with Our Privacy Statement. If you do not agree to these Terms or Our Privacy Statement you should not subscribe to this service or use the Site. Upon receipt of your details We will send a confirmatory e-mail to you and a new username and password will be created for you. You may not share these with any third parties. You are solely responsible for all use of and for protecting the confidentiality of any email verification, username and password used by you in connection with this service. You must notify Us immediately of any unauthorised use of them or any other breach of security regarding the Site that comes to your attention. We reserve the right to refuse any application to use the Pay Per Rent Service for any reason.

The Pay Per Rent Service is only available to persons over the age of 18. If you are requesting a Rental Disc for any other person, you must confirm that the intended recipient of the order is of the appropriate age to view that Rental Disc and that any minor’s viewing of any Rental Discs will be restricted by you in a manner consistent with any classification applied by the British Board of Film Classification to a Rental Disc. If a child watches an age-restricted title when they are not of the relevant age, they may become upset by the content of such title. Blockbuster urges you to act responsibly therefore when choosing a Rental Disc for viewing by someone else. If it comes to Our attention that you are allowing others to view age-restricted titles when they are not of the relevant age, We will terminate your subscription immediately and without notice.

Please ensure that you have read the Pay Per Rent Help section of the Site, which contains important information about costs, delivery times and general guidance on how to use the Pay Per Rent Service. The provisions of the Pay Per Rent Help frequently asked questions form part of these Terms.

All Rental Charges for Rental Discs set out on the Site are valid at the time of rental, unless otherwise stated. All prices are inclusive of VAT , and delivery charges quoted on placing the order are correct at the time the order is placed. You authorise Us to debit your nominated payment card to recover all charges and amounts due and owing to Us under these Terms, including but not limited to Rental Charges, Extra Night Option Fees (see "Delayed Return of Discs" below), and Rental Disc replacement costs. Without limitation, We also reserve the right to recover from you costs in respect of malicious damage and reasonable legal costs incurred in connection with the recovery of all outstanding charges and amounts owing by you.

Your payment card will be debited the Rental Charges on dispatch of your order to youand, for this reason, please ensure that the expiry date of your payment card is after the anticipated dispatch date - failure to do so may mean that We will be unable to fulfil your order. You confirm that the payment card that is being used is yours and there are sufficient funds or credit facilities to cover the Rental Charge.

All credit / debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Us, We will not be liable for any delay or non-acceptance of orders. We reserve the right to require further proof of identification, including proof of age, if an order is placed using a debit card.

You agree to take care of the Rental Discs and any accompanying packaging and/or documentation they are supplied with and to maintain all Rental Discs in good condition. We remain the owner of the Rental Discs at all times. Blockbuster will bear the risk of the Rental Discs being lost in the post once you have posted them back to Us provided that you take care of and return them to Us in accordance with these Terms, and subject to you returning a completed Lost Item Declaration Form (available from blockbuster.co.uk Service Team - see "Customer Complaints and Queries" below). If a Rental Disc is lost before reaching you, Blockbuster will endeavour to send you another copy of the same Rental Disc without extra charge, but is under no obligation to do so before any particular time or date or at all. Alternatively, and at our sole discretion We may offer you a refund of the amount you paid for the Rental Disc concerned. If you think that your Rental Disc has been lost in the post, you must contact blockbuster.co.uk Service Team as soon as possible to report it Lost In Post.

The appearance of a Rental Disc on the Site does not guarantee its availability. In the event of over demand for a particular title, to ensure that the maximum number of Our subscribers receive Rental Disc(s), We will allocate available Rental Disc(s) following fair and pre-determined criteria based on customer usage and period of time as a subscriber. We may review Our allocation criteria from time to time to ensure the greatest possible level of fairness at all times.

We shall deliver the Rental Disc to the delivery address that you supply, provided this is a valid address in the Territory. We aim to deliver your order to you as quickly as is possible. Most Rental Discs will be posted to you within 2 working days of receiving your order. We will advise you by email if there is likely to be a delay in dispatching your order. The Rental Discs shall normally be posted to you by first class mail. Any times or dates stated on Our Site for delivery are estimates only. We will make all reasonable efforts to deliver Rental Discs within the time specified, we cannot guarantee that such times will be met. We do not accept responsibility for any failure to deliver within that time if it is for a reason that is outside of Our control.

Each Rental Disc ordered will be delivered separately or grouped together to meet your order. If you order two or more Rental Discs and one is not in stock, We will ensure that the in-stock Rental Disc is sent as soon as possible, with the remaining Rental Disc being sent on as soon as it arrives in stock.

You must return any Rental Disc(s) in the same condition as they were in when dispatched by Us (fair wear and tear accepted). If damage is caused to any Rental Disc whilst rented to you, you will be personally liable for any such loss or damage and you expressly authorise Us to debit from your credit or debit card an amount equal to the replacement cost of the Rental Disc(s). You must return the Rental Disc(s) in the pre-paid return envelope(s).Only one item is to be used per envelope. Should you fail to do this and any Rental Disc is clearly damaged as a result, you shall be liable for the replacement cost of the Rental Disc. If you lose or misplace your envelope please contact blockbuster.co.uk Service Team for a replacement envelope. Alternatively, Rental Discs can be returned to the following address, using your own packaging, but if you do this you will be liable for any losses or damages that result: DBP, FREEPOST (SCE15059), Bradbourne Drive , Tilbrook, Milton Keynes, MK7 8BR.

Please do NOT return an online order to a Blockbuster high street store.

If:

(i) the Rental Disc delivered is not what you ordered or does not correspond with its description,

(ii) the Rental Disc delivered is not of a satisfactory quality, or

(iii) the Rental Disc is not fit for its purpose,

We will, at Our option, either deliver to you a replacement Rental Disc or refund to your payment card the amount paid for such Rental Disc.

If you fail to return any Rental Disc(s) when due you will be charged Extra Night Option Fees for each day that the Rental Disc(s) is overdue.

If you fail to return any Rental Disc(s) by the due date, We will remind you by e-mail to return the Rental Disc (s) as soon as is possible. If you still fail to return the Rental Disc(s) We will e-mail you again to inform you that, unless you return the Rental Disc(s) by the date specified in Our e-mail, your credit/ debit card will be debited by an amount equal to:

• the replacement cost of the Rental Disc(s); and
• the Extra Night Option Fees, subject to the maximum applicable at time of rental.

Under the Consumer Protection (Distance Selling) Regulations 2000 consumers normally have a right to cancel orders for the supply of services within 7 days of a contract being entered into. However, this cancellation right does not apply to the supply of services which are to be commenced within this 7 day period. You agree therefore that your rights under the Consumer Protection (Distance Selling) Regulations do not apply in this instance due to the fact that Blockbuster aims to post Rental Discs you order under this Pay Per Rent service within 2 working days of receiving your order.

However, Blockbuster may allow you to cancel an order by contacting the blockbuster.co.uk Service Team provided that the processing of your order is still in the early stages (that is before your credit /debit card has been debited and the order has been packaged up and is on its way out of the warehouse – orders cannot be cancelled at this stage).

Note, this address is not to be used for any returns.

We promise that all Rental Discs will correspond with their relevant description on the Site, and that they will be of satisfactory quality and fit for the purpose for which they are rented (i.e. non-commercial, domestic use in the Territory). We also promise that We will carry out Our responsibilities with reasonable skill and care. We do not make any other promises or warranties about the Rental Discs, or Our performance of the responsibilities assigned to Us in these Terms.

Save in the case of death or personal injury due to Our negligence or where We have acted fraudulently, Our total liability to you for any losses suffered by you will be limited to either the amount paid by you for the rental of the Rental Disc, or to the provision of a replacement copy of the Rental Disc concerned (where the original is returned to Us).

We accept no responsibility for any loss or damage caused by Us (or Our employees, agents or sub-contractors) where such loss is: a) not a foreseeable result to both you and Us (as at the time that you submit your order) of a breach of the relevant legal duty by Us; b) related to a business; or, c) related to loss or damage to premises or property unless caused by Our negligence or wilful misconduct.

The above limitations on Our liability do not affect your non-excludable statutory rights as a consumer.

You are responsible for the use of the Rental Discs that you obtain from Us. We exclude all liability, to the extent permitted by law, for any losses or damages you suffer from your use or attempted use of Rental Discs in countries outside the Territory.

Except in respect of a payment obligation, neither of us will be liable to the other for any failure to perform any obligation owed to the other due to causes beyond its reasonable control, for example,industrial disputes, fire, storms, failings of the internet or public communications networks, or technical difficulties.

You agree that you will use the Rental Discs for personal, private use. You agree that you will not use the Rental Discs for any commercial or illegal purpose or for any other purpose prohibited by these Terms. You agree to abide by the terms of any copyright notice contained on any Rental Disc, for example, the prohibition on a) copying of any of the Rental Discs; b) renting or otherwise supplying them to third parties; or c) allowing minors to view unsuitable material. You must ensure that the health of viewers will not be adversely affected by the viewing of Rental Discs (for example, epileptics watching films containing strobe lighting).

If you breach these Terms your permission to use the Site terminates immediately without notice being given to you. We may also suspend or cancel your right to use the Site at Our discretion if We deem it appropriate. Any termination or suspension of your use of the Site will not affect either your or Our responsibilities to each other arising prior to the date of termination or suspension. We shall not be liable for any loss or damage from the illegal, incorrect or inappropriate use of the Rental Discs by you or anyone else whilst they are in your possession.

Any failure, or delay by Us in exercising any right or remedy under these Terms shall not prevent Us from being able to enforce that, or any other, right or remedy at a later time. If any provision of these Terms is held to be invalid or unenforceable by any court or other competent authority, all other provisions will remain in full force and effect.

You agree that We may assign any of Our rights and/or transfer, sub-contract or delegate any of Our obligations under these Terms. Where We do so, We will take steps to ensure that it does not affect your ability to rely on the rights that you may have under these Terms. These Terms are personal to you and are entered into by you for your own benefit and not for the benefit of any third party – you may only transfer or assign your rights under these Terms with Our prior consent, which We will not unreasonably withhold.

In the event that We alter these Terms We shall take all reasonable and appropriate steps to make you aware of such changes, for example, by prominently displaying the amended version on the Site. If you do not agree to the amended Terms, please do not continue to use this Pay Per Rent Service.

In the event of any conflict between these Terms and the Web Site Terms and Conditions these Terms shall prevail to the extent that such conflict relates to your use of this Pay Per Rent service.

All notices shall be given:

• to Us via post addressed to the Online Service Team, FREEPOST Blockbuster, Harefield Place, The Drive, Uxbridge, Middlesex, UB10 8AQ; or
• to you at either the e-mail or postal address you provide during any registration or ordering process or by Us publishing relevant information on the Site.

Notice will be deemed received either when an email is received in full (or else on the next business day if it is received on a weekend or public holiday in the place of receipt), three days from the date of posting where any notice is posted, or immediately upon publication of any relevant information on the Site.

These Terms are governed by and are to be construed in accordance with English law. You agree that the courts of England, Scotland, Wales and Northern Ireland shall have the exclusive jurisdiction to settle any dispute which may arise out of or in connection with these Terms.
